Cher Client, aux termes de l'article 13 du Règlement UE 679/2016 (ci-après dénommé RGPD – Règlement général sur la protection des données) et des normes en matière de protection des données à caractère personnel, la société Starhotels S.p.A. (ci-après « Starhotels »), vous informe concernant le traitement de vos données à caractère personnel que celui-ci sera effectué dans le respect des principes de légalité, correction, transparence, finalité, minimisation, exactitude et limitation de la conservation. Responsable du traitement Aux termes de l’art. 4 point 7 du RGPD 2016/679, le Responsable du traitement des données est la Société Starhotels S.p.A., dont le siège administratif est sis à Florence - 50144, Viale Belfiore n° 27. Tél. 055.36921 - fax 055.36924. e-mail : privacy@starhotels.it Sous-traitant chargé de la protection des données à caractère personnel Aux termes de l’art. 37 du RGPD 2016/679, STARHOTELS S.p.a. a nommé un Délégué à la Protection des Données (DPO) de la compagnie, qui peut être contacté à l'adresse mail : dpo@starhotels.com. Courrier électronique certifié : starhotels_dpo@legalmail.it Sous-traitants chargés du traitement Si nécessaire pour l'exécution de ses activités institutionnelles, Starhotels identifiera et désignera formellement les Sous-traitants chargés du traitement, à savoir, selon les dispositions aux termes de l'art. 4, n°8 du RGPD, « la personne physique ou morale, l'autorité publique, le service ou autre organisme qui traite des données à caractère personnel pour le compte du responsable du traitement ». Les personnes concernées pourront, à tout moment, demander au Responsable la liste mise à jour des Sous-traitants. Finalités et base juridique du traitement Le traitement des données à caractère personnel sera effectué par Starhotels relativement au programme « I AM STAR » et il s'appliquera aux seuls clients qui adhèrent audit programme et dans le respect des finalités suivantes : a) gestion de la phase d'inscription au programme et émission correspondante des identifiants (user ID et mot de passe) pour l'accès à la zone réservée I AM STAR sur le site www.starhotels.com ; b) communication périodique et fourniture des avantages (réductions, services, avantages) prévus par le programme de manière durable ou occasionnelle pour des événements spécifiques ; c) communication d'autres initiatives publicitaires et promotionnelles réservées en exclusivité aux personnes inscrites au programme I AM STAR mises en œuvre par Starhotels, par des sociétés associées, liées, contrôlées, affiliées et par des partenaires de Starhotels S.p.A. ou par des tiers mandatés par ladite Starhotels. Les finalités indiquées seront poursuivies grâce au traitement de vos données à caractère personnel, dans le respect des principes rappelés en introduction. La base juridique, à savoir la condition qui rend le traitement légal, est représentée par le consentement explicite fourni par la personne concernée dans la section spécifique du site web ou sur les formulaires que l'on trouve dans la structure (art. 6, par. 1, lettre a) du RGPD). Catégories de données traitées et nature de l'apport Pour la poursuite des finalités décrites, les catégories de données à caractère personnel pourront être traitées : - données dites « communes » (ex. données d'état civil, données de contact - e-mail, téléphone). La fourniture des données est facultative, donc, il conviendra de fournir un consentement exprès au traitement des données par la Personne concernée. Après avoir donné son consentement, la Personne concernée peut, à tout moment, le révoquer, facilement et gratuitement, en s'adressant directement au Responsable du traitement, qui peut être contacté aux adresses indiquées ci-dessus. À partir de ce moment, Starhotels cessera ce traitement mais cela impliquera l'impossibilité d'être informé en temps voulu des nouveaux services proposés par notre société et de bénéficier de certains services et avantages réservés aux clients Starhotels. La révocation de l'autorisation ne nuit pas à la légalité du traitement basée sur le consentement fourni à l'origine. Modalités du traitement des données Le traitement des données à caractère personnel se fera à l'aide d'outils informatiques et analogiques par un personnel dûment autorisé, instruit et formé. Starhotels garantit l'application de mesures de sécurité adéquates, aptes à réduire le risque auquel les données pourront être exposées. Durées de conservation des données (Data Retention) Dans le respect des principes de proportionnalité et de nécessité, les données seront traitées jusqu'à ce que le client en demande la suppression du programme « I AM STAR ». Destinataires et diffusion des données à caractère personnel Les données recueillies seront traitées exclusivement dans le cadre des finalités ci-dessus et après consentement du client, elles pourront être communiquées à des sociétés contrôlées, affiliées ou dans tous les cas liées au Groupe Starhotels, tant en Italie qu'à l'étranger et exclusivement pour la gestion des services proposés aux clients Starhotels avec le programme « I AM STAR ». En outre, vos données pourront être communiquées, toujours dans le respect des mesures de sécurité adaptées, à des autorités publiques et à des sujets privés pour la réalisation d'obligations légales spécifiques, y compris celles de nature fiscale, administrative et financière. Les données à caractère personnel ne feront pas l'objet de diffusion. Lieu du traitement des données et cadres du transfert Les données sont traitées auprès du siège du Responsable du traitement et auprès des Sous-traitants spécifiés dans la liste ad hoc qu'il détient. Les données à caractère personnel seront traitées au sein du territoire italien ou dans tous les cas à l'intérieur de l'Union européenne, et ne seront pas soumis à un transfert vers des Pays hors de l'UE ou des Organisations internationales. Si, dans un rapport constant, le transfert s'avérait constant, le Responsable du traitement garantit le respect des dispositions visées au Chapitre V du RGPD. Droits de la personne concernée Le Responsable du traitement garantit l'exercice des droits visés aux articles 15 et suivants du RGPD, en particulier : 1. Droit d'accès ; 2. Droit de rectification ; 3. Droit à la suppression (à l'oubli) ; 4. Droit à la limitation de traitement ; 5. Droit à la portabilité ; 6. Droit d'opposition. Si les données à caractère personnel se réfèrent à des personnes décédées, les droits indiqués ci-dessus peuvent être exercés, selon les dispositions de l’art. 2-terdecies du décret législatif 101/2018, par quiconque a un intérêt propre, ou agit pour protéger la personne concernée, en sa qualité de mandataire, ou pour des raisons familiales dignes de protection. Traitements autorisés et profilage Le Responsable du traitement n'effectue pas de traitements automatisés y compris le profilage. Certified email (PEC): starhotels_dpo@legalmail.it Data Processors Where necessary for the performance of its institutional activities, Starhotels will identify and formally appoint Data Processors, i.e., in accordance with the provisions of Art. 4(8) of the GDPR, "natural or legal person, public authority, service or other body that processes personal data on behalf of the data controller". Data subjects may, at any time, request the updated list of Data Processors from the Data Controller. Purpose and legal basis of processing Personal data will be processed by Starhotels in relation to the "I AM STAR" programme and will apply only to customers who are members of the same and in accordance with the following purposes: a) Management of the programme registration phase and related issue of credentials (user ID and password) for access to the I AM STAR reserved area on the website www.starhotels.com; b) Periodic communication and provision of benefits (discounts, services, advantages) under the programme on a lasting or occasional basis for specific events; c) Communication of other advertising and promotional initiatives reserved exclusively for members of the I AM STAR programme implemented by Starhotels, by associated, related, subsidiary, affiliated companies and partners of Starhotels S.p.A. or by third parties commissioned by Starhotels itself. d) Profiling of subscribers through the analysis of transmitted data, selected services/products, tastes, habits, and expressed preferences in order to propose advertising messages and/or commercial offers in line with the choices made; The purposes indicated will be pursued through the processing of your personal data in accordance with the principles mentioned above. The legal basis, i.e. the condition that makes processing lawful, is the explicit consent given by the data subject in the specific section of the website or on the forms available on the premises (Art. 6(1)(a) of the GDPR). Categories of data processed and nature of provision For the pursuit of the described purposes, the following categories of personal data may be processed: - so-called "common" data (e.g. personal details data, contact data - email, telephone, browsing data, tastes, and preferences of subscribers). The provision of data is optional, therefore, express consent to the processing of data must be given by the Data Subject. Once consent has been given, the Data Subject may, at any time, withdraw it easily and free of charge by contacting the Data Controller directly, who can be contacted at the addresses given above. From that moment on, Starhotels will cease such processing, but this will mean that you will not be able to be promptly updated on new services offered by our company or to take advantage of certain services and benefits reserved for Starhotels customers. Withdrawal of consent does not affect the lawfulness of processing based on the consent originally given. Data processing methods Personal data will be processed using computerised and analogue means by duly authorised, instructed and trained personnel. Starhotels guarantees the application of appropriate security measures to reduce the risk to which data may be exposed. Data retention times In accordance with the principles of proportionality and necessity, data will be processed until the customer requests to be removed from the "I AM STAR" programme. Recipients and dissemination of personal data The data collected will be processed exclusively for the above-mentioned purposes and, subject to the customer's consent, may be communicated to subsidiaries, affiliates or otherwise associated companies of the Starhotels Group, both in Italy and abroad and exclusively for the management of services offered to Starhotels customers with the "I AM STAR" programme. Furthermore, your data may be communicated, always in compliance with appropriate security measures, to public authorities and private parties for the fulfilment of specific legal obligations, including those of a fiscal, administrative and financial nature. Personal data will not be disseminated. Place of data processing and areas of transfer The data are processed at the headquarters of the Data Controller and at the Data Processors specified in the list held by the Data Controller. Personal data will be processed within the Italian territory or in any event within the European Union and will not be subject to transfer to non-EU countries or International Organisations. If, during the course of the relationship, a transfer should become necessary, the data controller guarantees compliance with the provisions of Chapter V of the GDPR. Rights of the data subject The Data Controller guarantees the exercise of the rights set out in articles 15 et seq. of the GDPR, in particular: 1. Right of access; 2. Right of rectification; 3. Right to erasure (so-called right to be forgotten); 4. Right of restriction of processing; 5. Right of portability; 6. Right of opposition. In the event that the personal data relates to deceased persons, the aforementioned rights may be exercised, in accordance with the provisions of Art. 2-terdecies of Legislative Decree 101/2018, by those who have an interest of their own, or are acting to protect the data subject, in their capacity as their representative, or for family reasons worthy of protection. Requests regarding the exercise of rights should be addressed to the Data Controller at: privacy@starhotels.it. Automated processing and profiling The Data Controller, within the limits and in compliance with the conditions stated above, carries out subscriber profiling activities while ensuring the application of appropriate security measures.
